“They keep playing this game and Nahla is used as a pawn,” a source tells Us Weekly of the 4-year-old girl who is caught in the middle of her parents’ bitter custody battle.
After an ongoing bitter battle in court and a violent brawl outside her house on Thanksgiving Day, Halle Berry and her ex-boyfriend Gabriel Aubry seem to have called a truce.
On Thursday, the Cloud Atlas actress, 46, and her model ex, 37, “reached an amicable agreement” over the care of their 4-year-old daughter Nahla, Berry’s attorney Blair Berk stated after a hearing in Los Angeles, E! News reports.
Berk concluded: “There will be no further statement on the matter.”
Aubry, wearing a black sport coat with dark sunglasses to mask his bruised face, was present. Berry and her fiancé Olivier Martinez were not in attendance.
The settlement comes one week after the brutal brawl between Aubry and Martinez at Berry’s California home on Thanksgiving. Following the fight, an emergency protective order was put in place.
Aubry pled with a family court judge on Tuesday to lift a restraining order which keeps him at least 100 yards away from Berry, Martinez and his daughter. But the judge denied Aubry’s request.
Meanwhile, LAPD Commander Andrew Smith tells PEOPLE the violent Thanksgiving fight is still under investigation. “Our officers have initially concluded that Aubry was the primary instigator,” he says, but adds it’s too early to determine whether the case will be referred to prosecutors.
Gabriel Aubry’s Appeal Denied, Still Cannot See Nahla
After being badly beaten on Thanksgiving Day, Gabriel Aubry has just taken another blow. According to TMZ, a Los Angeles judge has denied his appeal to have the restraining order removed — which means he still cannot see his 4-year-old daughter Nahla.
Following the brutal brawl with ex-girlfriend Halle Berry‘s fiance Olivier Martinez at the actress’ California home, the male model, 37, pled with a family court judge on Tuesday (November 27) to lift a restraining order which keeps him at least 100 yards away from Berry, Martinez and his daughter.
But the judge denied Aubry’s request.
Although, due to a clerical error, the emergency order against Aubry will be lifted on Thursday (November 29) rather than the original later date of December 3. In order to extend the ban, Berry must file another request in court.
Both men were injured after Aubry dropped off his daughter for the holiday. Martinez, a former boxer, broke his right hand, while Aubry walked away with several facial injuries.
Aubry is claiming that he is the victim in the violent attack, saying that Martinez threatened to kill him before the fight came to blows.
This is the latest twist in the ongoing fight between the exes. During their custody battle over Nahla, there have been allegations of abuse, a custody evaluation report, and child support payment court orders.
Halle Berry Seeks Restraining Order Against Gabriel Aubry
After the blowout brawl at her house on Thanksgiving Day, Halle Berry is seeking a restraining order against Gabriel Aubry, TMZ reports.
The Academy Award-winning actress, 46, believes Aubry, 37, is a threat to their daughter Nahla after starting the fight with fiancé Olivier Martinez in front of the 4-year-old. Although a Los Angeles judge issued an emergency order of protection – requiring Aubry to stay 100 yards away from Berry, Nahla and Martinez – that order expires Tuesday, and Berry is now taking precautions against her ex.
Reportedly, Berry’s lawyers are heading to court early this week to make sure the temporary order of protection becomes more permanent. Sources say that Berry’s argument is simple: “If Gabriel can’t control himself enough to protect Nahla from emotional trauma, it’s too risky for him to be around her, Berry or Martinez.”
During their ongoing custody battle, Berry has repeatedly addressed Aubry’s anger management issues.
In another report since the Thanksgiving fight, the L.A. County Department of Child Protective Services will re-open an abuse investigation involving Nahla, Radar Online reports.
“Detectives from the LAPD formally contacted CPS after Gabe’s arrest, because Nahla was present when the fight occurred,” a source states.
The insider adds: “Nahla wasn’t actually involved in the melee, and by all accounts, Halle whisked her out of the driveway as soon as the fight between Olivier and Gabe started. However, DCFS was contacted because there has been a history of allegations of physical abuse. Social workers will be interviewing Halle, Gabriel and Olivier about what happened on Thanksgiving. DCFS must ensure that Nahla’s environment is safe.”
The day following the fight, Berry and Nahla were spotted at the Yo Gabba Gabba show in Los Angeles. Photos of Aubry and Martinez have surfaced since the brawl, showing no visible injuries for Martinez and a swollen face for Aubry.

Halle Berry’s ex-boyfriend, Gabriel Aubry, was arrested Thanksgiving morning following a fistfight with the actress’ current fiance, Olivier Martinez, at the actress’s California home just before 10 a.m.
Gabriel, 36, was taken to Cedars Sinai Medical Center in L.A. with fractured ribs and bruising to his face. Olivier, 46, injured his hand and neck.
A judge issued an emergency protective order to keep Gabriel at least 100 yards away from Halle, their daughter Nahla, and Olivier until Dec. 3.

A Los Angeles judge has reportedly denied Halle Berry‘s hopes for a future in France.
The Monster’s Ball actress – who is now engaged to French actor Olivier Martinez - has been fighting to move her 4-year-old daughter Nahla with ex-boyfriend Gabriel Aubry to Paris. According to TMZ, a judge ruled against the overseas move.
Despite their bitter custody battle, Berry claims she was not intending to keep Aubry away from his daughter for good.
She has claimed that France is a better place to raise her daughter rather than Hollywood, because of its “appeal of privacy and a greater sense of safety.”
“Because we are followed all the time, she is starting to feel like she is somehow special, and of course she is,” Berry continued. “But I want her to understand that she’s special because of who she is, not because she was born into this celebrity blender.”
